Florida Water Damage Claims Are Different

Florida’s property insurance market is the most complex in the United States. The combination of hurricane exposure, FEMA flood zone designations, the state’s Assignment of Benefits reform laws, and the ongoing insurer restructuring that followed the 2022–2023 market crisis has created a claims environment where documentation quality is the single biggest determinant of claim outcome.

The difference between a fully-approved claim and a partial payment or denial frequently comes down to two things: (1) whether the scope of damage was fully documented at the time of the event, and (2) whether the restoration contractor followed recognized industry standards (IICRC S500/S520) so the adjuster cannot argue the work was unnecessary or improperly performed.

Citizens Property Insurance

Citizens is Florida’s insurer of last resort and the most common carrier for Boca Raton homeowners. Their adjusters are specifically trained to look for deferred maintenance claims presented as sudden-and-accidental losses. Universal Property & Casualty

Universal is one of Florida’s largest private carriers and has specific moisture documentation requirements that differ from Citizens. Universal adjusters place significant weight on third-party air and moisture testing results, particularly for mold-adjacent claims. We include independent testing in our scope packages for all Universal claims that involve secondary mold concern, which substantially reduces dispute rates.

Florida Water Damage Insurance Claim FAQ

Do I call my insurance company or you first?

Call us first. Here’s why: insurers encourage you to report quickly, but there is no coverage benefit to reporting before you have a scope of damage. If you call your insurer first and give them an estimated scope before we arrive, that estimate becomes the baseline your adjuster works from — and it will almost always be an underestimate. We document the full scope on arrival, then you report with complete documentation. The resulting claim is significantly more complete than one filed before professional assessment.

What if I already reported to my insurance before calling you?

That’s not a problem — it’s the typical situation. Initial report does not limit your final claim. Once we complete our assessment and document the full scope of damage, you or your adjuster can supplement the initial report with our complete documentation package. Supplemental claims are common and normal in Florida — especially in events where damage is discovered progressively as drying exposes more affected materials.

Will my claim go up because I filed for water damage?

Under Florida law, insurers cannot non-renew a policy solely because the insured made one claim in the preceding 36 months. In practice, one water damage claim in Florida rarely triggers non-renewal or significant rate increases on its own, particularly if the cause was sudden and accidental (a pipe burst, an AC drain, a storm event) rather than maintenance neglect. We recommend consulting your insurance agent directly about your specific policy’s claim history provisions. For most homeowners, the cost of not filing — paying out of pocket for a $15,000–25,000 event — substantially outweighs any premium consideration.

Do I need a public adjuster?

A public adjuster is an optional advocate who works on your behalf for a percentage of the settlement (typically 10–15% of the claim amount). For complex, high-value claims — particularly those involving disputes, denials, or multiple damage types — a PA can add significant value. For straightforward water damage events with clean documentation, most homeowners do not need a PA. Our documentation quality is a significant factor here: complete, IICRC-compliant scope reports with full photo documentation resolve cleanly without dispute in the majority of cases we work. If we encounter a claim that we believe needs PA support, we will tell you and refer you to qualified PAs in Palm Beach County. We do not receive referral fees.

My insurer says the damage is from maintenance neglect, not a covered event. What can I do?

Maintenance exclusions are one of the most common grounds for Florida water damage claim denials. The insurer must prove the damage resulted from a condition that was known to the homeowner and neglected over time, not from a sudden-and-accidental failure. Our moisture documentation and timeline evidence often provides the key factual basis for disputes: if our readings show a dry structure in areas that would be wet from a slow leak, it supports a sudden failure argument.
